january 8th, 2013. from nbc news, this is "today" with matt lauer and savannah guthrie live from studio 1a in rockefeller plaza. welcome to "today" on a tuesday morning. i'm savannah guthrie. >> and i'm matt lauer. that hot air balloon wedding may appear to be smooth sailing compared to what we're about to see on capitol hill with confirmation hearings when they get under way with chuck hagel and others. >> yeah, john brennan. the president getting pushed back on his choice for cia director and defense secretary. both men now having to defend their records and some controversial statements in their past. we'll get the latest, straight ahead. also ahead, emotional testimony at a preliminary hearing tied to that shooting massacre at a movie theater out in aurora, colorado. from the first police officers

its campaign machine, if you will, to sell a skeptical u.s. senate on the idea of chuck hagel running the pentagon. it's been a rough preselection vetting process up to date. he is clearly frustrated and it now speaking out. >> mr. president, i will always give you my honest and most informed counsel. >> reporter: chuck hagel's nomination set up a tough new political fight for the white house, a fight president obama signaled he is ready to have over the plain-spoken vietnam veteran. >> his willingness to speak his mind, even if it wasn't popular, even if it defied the conventional wisdom, that's exactly the spirit i want on my national security team. >> reporter: under fire for his past statements about israel and iran, hagel is speaking out, telling his hometown newspaper the distortions about my record have been astounding, once describing pro-israeli groups about a jewish lobby, unilateral sanctions on iran, he now says there's not one shred of evidence that i'm anti-israeli, not one vote that hurt israel.

and he says unilateral sanctions don't work and they just isolate the united states. republican critics, though, aren't convinced. >> he is an honorable man. he has had a record of distinguished service but he's profoundly wrong on a number of the most important national security issues that face our country today. >> reporter: key jewish groups being lobbied, that has helped soften the anti-defamation league, who wrote senator hagel would not have been my first choice, but i respect the president's prerogative. >> the white house is reaching out to a number of groups and individuals with regard to this nomination and others. >> reporter: hagel is also likely to face questions about his position on gay rights after his 1998 comments criticizing a u.s. ambassador nominee as, quote, openly aggressively gay. hagel has since apologized but one openly gay senator says she would like to hear more. >> i do want to speak to him particularly about his comments 14 years ago to see if his

apology is sincere and sufficient. >> reporter: monday the white house faced protests but not over chuck hagel. demonstrators protested the president's choice of john brennan to run the cia. he withdrew his name from consideration of the job four years ago over his connection to controversial interrogation techniques like waterboarding that date back to the bush years. believe it or not, brennan's nomination is being seen as getting through the senate fairly easy. as for hagel, some democrats yesterday weren't exactly supportive, chuck schumer of new york, number three democratic in the senate. one of the more powerful ones there, seemed to sign a skeptical note. he didn't come out, outright supporting the idea of chuck hagel. >> chuck todd in washington for us. thank you. matt? savannah, thanks. gripping testimony monday during a preliminary hearing for that suspect in the movie theater

massacre in aurora, colorado. the shooting left 12 people dead, 58 others injured. mike taibbi is at the courthouse in centennial. good morning to you. >> reporter: good morning, matt. prosecutors haven't said whether they will seek the death penalty. he could end up with a sentence of life in prison without the possibility of parole. in this hearing, the details of exactly what happened just after midnight last july 20th are being made public for the first time. more than 100 victims, relatives and victims' survivors packed the courtroom and two overflow rooms to hear details of the case against james holmes, disheveled and bearded in court and seemingly uninterested in the proceedings. the young police officer who arrested holmes said at first he thought he was a s.w.a.t. team cop because of the way he was dressed but put him in handcuffs because he was just standing there outside theater nine,

quote, very, very relaxed. like they weren't normal emotional responses to anything. he seemed very detached. detached after leaving behind a tear-gas filled killing zone where the latest "batman" movie had just started. holmes having bought his ticket online weeks before, evidence of prior planning says one psychiatri psychiatrist. >> you can be in a detached state of mind, psychotic state of mind, not clear thinking poor judgment state of mind because of the mental health problem or something else and be planning this stuff and premeditated it. >> reporter: police witnesses nearly broke up, describing the scene. officer justin grisol explaining he rushed six of the victims in his car because, he whispered, i didn't want them to die. when he checked the littlest victim, 6-year-old veronica moser sullivan, and found no pulse. terrible details, but details that have to be made public.

>> it's just a piece to the closure. i definitely want to make sure that the integrity of the case is intact to that we don't have to repeat this in the future. >> reporter: if this case does go to trial as a death penalty case, the overwhelming evidence revealed in this preliminary hearing has legal analysts saying holmes' only option is an insanity defense. >> not only is this not a whodunit, but it's very likely a mission from the defense perspective just to save their client's life. life in prison would be a huge victory for the defense. >> reporter: it will continue to be difficult in court this week. prosecutors have still photos and hours of video and witnesses. meantime, the theater is expected to be reopened next thursday. that could be controversial. matt. >> mike taibbi in centennial, colorado, this morning. mike, thank you very much. savannah? >> matt, thanks.

we're getting an update on the state of cancer in the united states, a new study released in the journal of the national cancer institute. overall the death rates are inching down, but a rise in hpv-associated cancer is cause for concern. dr. nancy snyderman is nbc's chief medical editor. let's start on a positive note. >> sure. >> the death rates from cancer are continuing this 20-year trend downward. >> overall since 1970 when nixon declared a war on cancer. lung cancer is down. we aren't smoking as much. some obesity cancers have gone up. overall, it's a good benchmark at this 20-year measure. >> talk about the cancers associated with the human papilloma virus. >> good news, bad news. hpv cancers are markedly up. this is a sexually transmitted virus. we've seen a spike in the last few years. anal cancers have doubled in the last four years. even more are oral cancers, we've seen those double or

triple in the last ten or 12 years. the reason is it's now been out there. it also is a virus that causes cancer of the cervix, but pap smears and the phenomenal screening have made it a curable cancer. we haven't taken that kind of screening to cancer of the mouth. the most important thing i want parents to know is this is also a preventable cancer in most cases. >> there's an anti-cancer vaccine, a little controversial. >> but i don't understand why it is controversial. every 20 some-year-old should now be vaccinated and the cdc has dropped the recommendation down to 11 and 12-year-old boys. this is not a vaccine so you can say to your children, okay, go have sex without commitment. that's not it. it's an anti-cancer vaccine. three doses over six months. when you get this vaccine, it allows your body to build up the antibodies so that when you are exposed to hpv -- and the likelihood is that everyone will be exposed to it at some point,

you won't get cancer 10, 20 years down the line. >> is it effective for preteens? >> most effective before you've been exposed to the viruses and really geared to the types that cause cancer. i really want to refrain this. the hpv vaccine is an anti-cancer vaccine and the best tool we have now to prevent these illnesses. >> dr. nancy snyderman, thank you. we'll see you later on in "today's" professionals. let us get a check of the rest of the morning's stories. natalie is standing by. good morning. >> good morning, matt and savannah. good morning, everyone. the deadly attack on the u.s. embassy in benghazi has now been freed. the attack back in september killed the u.s. ambassador along with three other americans. exactly two years since the deadly shooting that wounded former congresswoman gabrielle giffords, the former representative from arizona is launching a new organization to

fight gun violence. this, as a connecticut lawmaker is apologizing for posting on facebook that giffords should, quote, stay out of my town. giffords has been in town last week to visit the families of the shooting victims. a standing ovation for secretary of state hillary clinton who returned to work on monday after a concussion and a blood clot sidelined her for the past month. to welcome her back, clinton staff gave her a football helmet to protect her from any future cushion and the contact sport that is of course washington politics. federal complaints about foreclosure abuse with an $8.5 billion payout. for the latest on this massive settlement, let's check in with cnbc's kayla tausche. good morng, kayla. >> good morning, natalie. that settlement is based on claims that banks improperly fore closed on houses in the wake of the financial crisis. it includes more than $5 billion in mortgage assistance. critics say that's too little.

meanwhile as the economy recovers, the credit available to consumers is expanding. data out today is expected to show that rate is slowing. natalie, the stock market is still up in 2013. that is good news. >> we'll take it. thank you, kayla. commuters nightmare at rush hour in a new jersey train station when this escalator suddenly changed direction. at least four people were injured in the incident. a great night for alabama's star quarterback as the 22-year-old led the crimson tide to a second consecutive bcs title, 42-14 last night in miami. matt was right. but mccarron's girlfriend, katherine webb, got a little more attention than mccarron may have bargained for. brent musberger spotted her in the crowd. >> you quarterbacks, you get all the good-looking women.

out of mexico, bringing rain already into southern texas. a risk of severe storms out of this thing. as you can see over the next 48 hours, moisture comes in out of the gulf, energy from the low really gets wound up. rainfall amounts. first of all, flood threats, flash flood threats and we're talking rainfall over 5 to 7 inches of rain along parts of eastern and central texas. it could have a great effect, at least, of knocking down the drought. flooding could be a big problem as well. we'll get your local forecast right after this. total of about $10,000 back." i wave my wand and refunds suddenly appear. i can help you.

good morning. i'm meteorologist christina loren. we do have thick pockets of fog across the bay area. travel cautiously. give yourself extra time if you wake up in interior inland valleys. throughout the day we hit the 60s by the finish. 66 inland. 65 bayside and 65 at the coast. temperatures tumble by tomorrow down to the 50s and we get a few showers late wednesday into thursday. and that's your latest weather. >> al, thank you. police in chicago now have opened a homicide investigation into the death of a man who died just one day after he received a big lottery payout. andrea canning is here with the details on that. good morning to you. >> good morning. at first, nothing seemed to be out of the ordinary. the death happened last july and was initially attributed to natural causes. toxicology tests show the lottery winner actually ingested

a lethal dose of cyanide. now investigators have a mystery on their hands. 46-year-old urooj khan won the $1 million lottery off a scratch ticket he bought from a chicago 711 last june. >> he was so generous, like $100, throw it on the counter for me. >> khan was planning to use the money to help his dry cleaning business, but one day after a check for nearly $425,000 was mailed to him last july, he died. at first, the cook county medical examiner's office ruled it a death by natural causes. >> family member contacted the doctor who had done the autopsy and suggested that we might want to look a little further into the case. >> reporter: officials now say khan's death is a murder mystery, with no suspects named so far. after comprehensive toxicology tests showed a lethal dose of cyanide was found in his system. >> a chemical poison.

basically biochemical level it asphyxiates you. a little does go a long way. >> reporter: the night of his death, he had dinner with his wife and teenage daughter and went to bed. he was later heard screaming and taken to the hospital where he was pronounced dead. khan's widow has spoken to police but has made no additional comments. investigators will likely exhume khan's body and perform an autopsy in the days to come. >> thank you, andrea. here's matt. we're getting incredible video this morning from san diego. it gives a whole new meaning to the term wedding crashers. mara schiavocampo has the story. >> reporter: good morning. talk about making memories. the bride and groom along with six other friends and family members took to the skies for their dream wedding. shortly after the i dos, an unexpected twist. >> fortunately, we didn't end our marriage the day we began

it. >> reporter: they had a wedding they won't soon forget. take a look at how it ended. >> brace. hold on. yeah! >> reporter: that's right. after the san diego couple got married in a hot air balloon, they were wedding crashers. a gust of wind blew their wedding party into a fence in a suburban neighborhood. >> the minister married us. although i don't think we said i do. >> yeah, we said -- >> we said i do? next thing we know, we're crashing into a fence and killing a tree and, you know, i said jesus about four or 5,000 times. >> reporter: the wind swung the balloon's basket like a pendulum, forcing the pilot to make a crash landing. mark carlisle saw it from his backyard. >> heard a lot of screaming so we ran out there as fast as we could and found a bride and groom, a wedding party, and a

bunch of very relieved people. >> reporter: although there was no significant damage to any homes in the neighborhood, crews had to work through the night to get the enormous balloon off the roof. >> disconnect it from the basket. >> reporter: despite the bumpy landing and a few scrapes and bruises, the newlyweds remained in good spirits in what was a second marriage for both. >> i was laughing. >> we're adventurers. i always said to my kids if i ever get married again i'm going to get married in a hot air balloon. >> she told me she dreamed about our wedding and we were getting married in a hot air balloon and i said i'm scared of heights. i won't tell you the rest of what i said. but i went up in the balloon. when you love someone -- >> it is a beautiful place. >> reporter: a bumpy start, but smooth sailing toward a new life and memories they'll never forget. the good news, no one suffered any serious injuries. the couple is now on their honeymoon with quite a story to tell.

>> good morning. i'm jon kelley. the investigation into why an empty oil tanker hit the bay bridge continues this morning in san francisco. it hit the western span of the bay bridge late yesterday morning. the impact did not damage the bridge but ripped off a part of the fender there to protect the tower. the coast guard will now interview the pilot and guy kleess this morning. he did pass an alcohol test and a drug test. those results now are pending. according to the mercury news, kleess has a spotty history. state records show back in 2009 he ran a cargo ship aground in the sacramento shipping channel and crashed a cargo ship into a catwalk near stockton in 2010. he was found at fault when a tug boat he was sailing ran aground in richmond inner harbor.

at a time. what he is doing online that has his entire town smiling. "today's" professionals are back together again. one of the topics we'll get into, reports that lance armstrong may change his tune and admit that he used banned performance-enhancing drugs, something that his representatives, i think, deny. >> denying, yes, but it's a story in "the new york times." an alleged sex assault case out in ohio, getting a lot of national attention. the victim just 16 years old. in a moment we'll talk to the former guardians of one of the high school football players charged in this case. first, nbc's ron allen is in steubenville. ron, good morning. >> reporter: good morning to you, matt. former guardians say they're coming forward to speak out for one of the defendants because they feel he hasn't been getting a fair hearing in the court of public opinion. we tried to talk to the young alleged victim and her family, but their attorney declined, saying that she is still struggling with what happened to

her. and it's fortunate that they don't live in this small town still reeling from this case. >> a very laid back young man, not, you know, outspoken or anything. >> reporter: greg and jennifer agresta say they met him when he was 8. living in a troubled home, his parents unable to take care of him. the agrestas became his legal guardians. he lived with them for two years and have remained close ever since. he is now under house arrest at their home. >> he knows we love him dearly and he knows if he's convicted and found guilty, whatever may happen, we love him and support him. >> let's be clear. they knew she was drunk. >> reporter: in court, prosecutors claimed richmond and co-defendant trenton mays treated the alleged rape victim, quote, like a toy, party hopping the night of august 11th, drinking heavily, the girl unconscious at times. mays allegedly attacked her in the backseat of a car while a

friend, prosecutors say, took pictures that he later deleted. later that evening, prosecutors say, richmond attacked the girl along with mays while she was passed out in a basement. the defense claims everything that happened was consensual, no force was involved. both young men, high school sophomores, quarterback and wide receiver on the steubenville high school football team, have pleaded not guilty. and now another teenager, who protesters have directed their anger at, has said he is sorry for appearing in this videotape that's gone viral, joking about the alleged victim. >> she's deader than a door nail. >> i don't believe that it's a crime, but it's stupid. >> reporter: an attorney said the young man, who we only called michael, insisted he was not at the party where the alleged attacks occurred and said he was drunk and commenting on what he had been told had happened. >> with some sober reflection,

he is ashamed and embarrassed to hear them himself. he sincerely regrets his behavior. >> reporter: he has not been charge charged with a crime. and the attorneys for the two defendants in the case, mays and richmond, say they're probably going to try to move the trial far away from here and delay the proceedings until some of the emotion dies down. matt? >> ron allen, thank you very much. jennifer and greg agresta are with us, exclusively, along with malik richmond's attorney, roger matheson. so malik is home, in your home right now. although you're no longer his legal guardians. that's correct, right? what was his reaction when he found out he was being charged with this crime? >> he was surprised. we weren't with him, obviously, when he found out. as i think everybody was surprised.

it's out of character for malik. and i think everybody just was in shock. >> you describe him as a laid back young man, a guy who is not outspoken, a quiet kid. yet he is charged with a very serious and disturbing crime. what was your reaction when you heard these charges? >> i was very disappointed in the judgment that was exercised at that point in time. it's completely out of malik's character. that's not the type of person that he is. one thing that i will mention, jennifer and i are very private individuals, matt. it was very difficult for us to make the decision to come to new york and speak about the situation. >> why did you? >> but to be honest with you, the right thing to do is always the hardest thing to do. we're here as individuals. we've had malik since he was 8. even when he went back home with his mom and dad, he has always been part of our family, always. and even to this day -- the problems you have in society today, too many people want to share the good times and when

individuals and family members run across difficult times, right or wrong, they want to bail. >> and i appreciate that. yet i know that this young man trusts you. he confides in you. have you had that hard talk with him about this? have you said, malik, what happened? tell me the details of what happened the night in question. have you had that talk with him? >> no, because it doesn't matter to us. we love him, irregardless of what happened that evening. we want him to know that we support him. when he left our home as a young child, the last thing i said to him when i dropped him off was malik, if you ever need anything, good or bad, we are a phone call away. and when he called us, we were just that phone call away. we had to be there for him. >> i want to make sure i understand this. you told him you're always there for him. >> correct. >> do you think the charges are accurate? do you think he was involved in this situation where this 16-year-old young lady was sexually assaulted?

>> you know, matt, that's a very difficult question for them. under advice of counsel, i've shielded the family and tried to protect the integrity of this attorney/client relationship. malik and i talked and those conversations, naturally, are protected and private. the thing that's most important for malik in terms of support, as they've indicated, it takes a village to raise a child. he needs the support from the family. >> i understand that, mr. madison. however, the fact of the matter is that he is being charged with a very serious crime and this is going to come down to what happened on the night in question. you have said that everything that happened that night was consensual. >> uh-huh. >> however, there are some photos that have been circulating around on social media, on the internet. some have been taken down. but i know you've seen them. you've all seen them. one shows two young men, one is malik, carrying this young lady who appears to be unconscious. how do you coordinate this idea

of consensual and unconscious? >> they're privy to some of the conversations we've had. it's important for everyone to understand this very clearly. that video has nothing to do with malik richmond. he was not present. he did not produce that video. >> was he one of the people involved in that photo, though? is he seen in that photo? >> he is seen in that photo. the other problem becomes that the photo taken in conjunction with the video draws this negative inference that's gone way out of proportion. and the video, as we know, it can be reduced to that young man's form of expression. >> let me ask you two real quick questions. one, do you think you can get a fair trial for this defendant in this town? >> we cannot. matt, it has gone to the point where witnesses are reluctant to participate for fear of being vilified and placed personal information on the internet. >> and the question to you, there's been talk that other

people may have been involved in this incident this night and perhaps they are being protected because they are part of this football team, and this town reveres this football team. is that within consideration on your part? do you think there are others involved? >> i have no comment to that. the other thing i would say, matt, at the end of the day, we have the best judicial system in the world. embrace the process and let it work. we respect those people for the opinions they have, that are protesting. in turn embrace the justice system. it does work, right or wrong. >> thank you for joining us this morning. mr. madison, thank you. >> thank you. let's get a check of the weather from al now. >> matt, thank you. another big system coming on shore in the pacific northwest. that will not only bring rain but snow. some parts of the pacific northwest have avalanche warnings in effect, anywhere from one to two feet of snow in the mountains. rainfall anywhere from two to

good morning, everybody. i'm jon kelley. an autopsy taking place today for the petaluma teen who was found dead in a south lake tahoe snow bank. investigators say 19-year-old alyssa byrne was disorientated when she left a music festival on new year's eve. she apparently took a wrong turn and at some point took her jacket off. it was less than ten degrees out that night. a utility worker found her body on january 4th not too far from the concert venue. investigators say they do not anticipate that foul play was involved. once we get past all of that fog out there, christina loren is telling us it looks like it will be a nice day. good morning. >> good morning to you, jon. it is going to be so nice by january standards in the bay area. we're talking about temperatures approaching 70 degrees in some cases. not quite hitting that 70-degree mark but once we get rid of fog which you saw from sunol already starting to clear. we'll see a nice sunny finish to the day. thick pockets out there that could slow down your drive. we'll check on details with mike in just a moment.

>> that's good. all right. get online. some people think these characters are so entitled, these 20 somethings are so self absorbed. what do you say about that? >> i would be curious to know what it was like for you guys to -- for me, i sort of object to the notion that characters have to be likable. i feel like i don't like most of my friends. i love them. that's the same way i feel about the characters that i write. i think it's important to have characters on television who are sort of ambiguous and complex, the way that people are, especially female characters. so often women are relegated to sassy best friend or evil job go ing bioch. >> i think humans every day are

desperate search for an american journalist missing in syria. james foley was kidnapped thanksgiving day. now his family is speaking out to his captors for his safe release. his mother is here with us along with his brother, michael. good morning to both of you. >> good morning. >> it's hard to meet upped these circumstances. diane, why don't you tell me the last time it is that you had contact with james? >> well, he called, actually, just a few days before thanksgiving, because my aunt -- i have a 104-year-old aunt who had died and he knew what a loss it was for me. and he called just to say he was sorry and he would be home soon and was thinking of me. >> he is a freelance journalist, working in syria. needless to say, this is an incredibly dangerous place to do reporting. do you know anything, michael, about the circumstances of his

capture? >> we do. there was some eyewitness accounts. you know, they were taken by some armed gunmen. but beyond that, we don't have a lot of information. that's one of the reasons we're here today. >> that's part of the problem. >> there's been no contact whatsoever? >> no contact. none. >> michael, let me ask you. we've seen, unfortunately, these circumstances before. and in many cases, the journalist organizations will say, don't report on it. don't release the name because it endangers the person in cap active i captivity. i know you followed that for a while, too. you now have decided to switch strategies and go public. why? >> it's pretty simple. after 40 days without information, we felt it was important to make people aware, remind them that jim is an objective journalist, innocent journalist who is doing his job and to appeal to the people who are holding him, to release him safely, release him unharmed and

also because of the lack of information that we have. i ask people to go to the website that we have set up, freejame freejamesfoley.org, to provide us information if they have any. >> what should people know about jim? obviously this is somebody who is quite courageous, if he's going into these active war zones and reporting. >> he is a very passionate young man and he really wants to give voice to people in conflict. you know, he is very interested in people. a really good listener. and really cares. particularly about the vulnerable ones, the children in the midst of the war. and the civilians in the midst of it all. >> i understand that his background is actually in education and teaching. how did he make the turn to become a journalist? >> well, i think he always has been involved in writing and photography. and he cares about the human story. i think it was a natural combination really. >> that's so true. >> what kind of effort, to the extent you can talk about it,

have you undertaken to try to learn more about where he is, to get the word out? >> we've done a lot. but, unfortunately, jim is a freelance journalist. global post is an organization he has done a lot of work for. they've stepped up to put an organization behind jim. but we've turned over every rock, as you can imagine. >> diane and michael foley, i can only imagine these are incredibly tense times for you. this happened in libya, i should mention. he was covering the situation in libya and disappeared for a period of 30 days. >> that's right. >> but he was sighted then. we have not even seen him. no one has witnessed him since he was kidnapped. >> it's very different. >> it's very different that way. we don't know who is holding him and we would -- we really need to hear from jim.

>> that's right. my good friend bernie came here to me one day and said you realize in buddhist circles the dude is considered a zen master? >> the dude from the big lebowski? >> the dude from the big lebowski. and eye said what are you talking about? and he went on to explain how there are many -- all sprinkled through the movie. and i said, well, let's get into that. so we started talking about it. and he said, hey, you want to write a book? i said, well, let's try that out. >> the film had a huge cult following. you're telling me the bowling shoes wearing dude is a zen master? what do you feel that we can all take a lesson from? >> yeah. the dude is not caught up with being so attaching himself to what he's all about.

he sort of flows with the moment, you know. instead of the dude trying to make the world do what he wants it to do, he is doing what the world is doing. and that's what zen is all about. >> that's true, finding that moment. >> my daughter said a cool thing. i wesh we had put it in the book. she said the dude, he's not really into doing so much. he is not a doer. he is dude. >> you guys cover a lot of ground in the book from movies, you've been in acting. marriage, insecurities, fears. and, jeff, i know you're married to your lovely wife, susan, for 35 years. >> yeah. >> it took you some time to finally pop the question. >> oh, yeah, a long time. >> how did you finally come around? >> i did myself this terrible out. i said i can always get a divorce. >> oh, ow! >> but i'm not going to let this girl go, because i can imagine

looking down years from now and saying oh, that was the one. so my wife, thank god, she put up with me for about two or three years of just pouting terribly. she said, listen. i said no, no, no. thank god she didn't kick me to the curb. >> ever since then it's wedded bliss? >> getting better and better. getting deeper and deeper into all of the stuff. >> 35 years later. meanwhile you have great examples in your parents, your father the great actor, lloyd bridges, who inspired your acting career. what is it that you really learned from him the most? >> joy, i think, the way he approached his work with tremendous joy. he really loved what he was doing. and the joy was kind of contagious, you know. whenever i got to work with him as an adult a couple of times. whenever he came on the set, you could feel that. everybody says, oh, yeah, this is kind of fun what we're doing.

companions. they strike me as medical tools. how does it work, first of all? how does a dog sniff out a seizure? >> a dog can smell 100,000 times better than we. their senses are heightened. depending on the dog and the malady, we've known for a long time -- obviously we have seeing eye dogs. we know dogs can sniff out certain cancers. they're being used for peanut allergies, low blood sugar problems and now seizures. i can't explain to you chemically what the human body sends off that the dog can pick up. it's not german shepherds anymore. it just requires a really good program and four paws for ability, which helps so many children, they've been instrumental in teaming the right child with the right dog for the right malady. >> what's the process like? how do you train a dog to sniff out a seizure or cancer or to be a seeing eye dog? >> it's interesting. it is elaborate. that's put dogswith, believe it or not, nonviolent prisoners.

mountain view police arrested 53-year-old daniel garcia of fresno just this past friday. he was caught after the crime lab developed a dna profile from the fingernails and eventually matched it to garcia. garcia has been booked on suspicion of murder. after the break, we will take a look at this forecast and the roads.
